Welcome to School Auto. These Terms and Conditions ("Terms") govern your access to and use of the School Auto mobile application (the "App") operated by BrightPen OPC ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By using the App, you confirm that you have read, understood, and agree to these Terms. If you do not agree, you must not use the App.

2. Description of Service

School Auto is a mobile application that helps parents and drivers track school auto rides. The App provides tools for:

• Viewing a vehicle's real-time location on a live map.
• Receiving ETA, stop, and pick-up / drop alerts.
• Confirming pick-ups and drops at each stop.
• Managing child profiles, vehicles, routes, and stops.

3. User Accounts

To access the App, you must sign in with a phone number and verify it via OTP. As a parent, you may be invited by a driver to track their vehicle. You are responsible for:

• Providing accurate registration information.
• Maintaining the confidentiality of your account and device.
• All activity that occurs under your account.
• Notifying us immediately of any unauthorized use.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Content

You retain ownership of the information you provide through the App, such as child details and profile information ("User Content"). By using the App, you grant us a limited license to store, process, and display your User Content solely to provide the service. You are responsible for ensuring that any information you provide about other individuals (including children) is accurate and is provided with appropriate consent.

5. Acceptable Use

You agree not to use the App to:

• Misrepresent a vehicle's location, route, or stop status.
• Track or monitor individuals without a legitimate relationship to the ride.
• Violate any applicable law or regulation.
• Interfere with or disrupt the App's servers, infrastructure, or other users' access.
• Attempt to reverse engineer, decompile, or disassemble the App.

6. Intellectual Property

The App, including its design, code, graphics, logos, and underlying technology, is the property of BrightPen OPC and is protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or other proprietary elements without our prior written consent.

7. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis. Location, ETA, and alert information depends on device connectivity, GPS availability, and driver input, and may be delayed, inaccurate, or unavailable. We do not warrant that:

• The App will be uninterrupted, error-free, or secure.
• Location or ETA information will always be accurate or current.
• The App will meet your specific requirements.

8. Limitation of Liability

To the fullest extent permitted by law, BrightPen OPC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or in connection with your use of the App. You are responsible for supervising children and should not rely solely on the App for their safety.

9. Indemnification

You agree to indemnify and hold harmless BrightPen OPC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the App or your violation of these Terms.

10. Termination

We may terminate or suspend your access to the App at any time, with or without cause and with or without notice. Upon termination, your right to use the App will immediately cease. Provisions that by their nature should survive termination shall remain in effect.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the courts located in Chennai, India.
